The Economic and Financial Crimes Commission (EFCC) has appealed the judgment of the Federal Capital Territory (FCT) High Court, Abuja, which found the anti-graft agency liable for defaming former Minister of Power, Olu Agunloye, over a social media publication relating to the alleged $6 billion Mambilla Power Project fraud.
The Commission filed its Notice of Appeal at the Court of Appeal, Abuja, on Friday, July 10, 2026, through its counsel, Wahab Shittu (SAN).
According to the appeal in Suit No. FCT/HC/CV/1199/2024, the EFCC is challenging the entire judgment delivered on July 8, 2026, by Justice Peter Kekemeke of the FCT High Court sitting in Maitama, Abuja.
The Commission expressed dissatisfaction with the ruling and urged the appellate court to overturn the decision.
The appeal is predicated on 11 grounds and seeks four principal reliefs, including an order allowing the appeal, setting aside the judgment of the trial court, dismissing Agunloye’s suit in its entirety, and granting any other order the court may consider appropriate.
Justice Kekemeke had held that the EFCC’s publication concerning Agunloye was false, defamatory and damaging to the former minister’s reputation. The court subsequently awarded N10 million in damages against the Commission.
In addition to the appeal, the EFCC, through Shittu, also filed an application for a stay of execution of the judgment pending the determination of the appeal.
No date has been fixed for the hearing of the appeal.
